NSW legislation changes

Starting February 13, 2025, New South Wales (NSW) will require all fire protection systems to be maintained in accordance with the AS 1851-2012 Amendment 1 standard. This regulation brings NSW in line with the rest of Australia and aims to ensure that all fire safety systems are reliable and effective when needed.

Residential Property Fire Safety Management

Under Clause 146A of the Environmental Planning and Assessment Act 1979, and Division 7A of Part 9 of the Environmental Planning and Assessment Regulation 2000, at least one working smoke alarm must be installed on each level in all buildings in NSW where people sleep. The smoke alarms must the requirements of Australian Standard AS 3786. These provisions came into effect on the 1st May 2006.

From 23rd March 2020, updated Residential Tenancy Regulations (NSW) came into force mandating increased obligations for landlords and property managers regarding smoke alarm maintenance including annual testing and battery replacement. NSW Fair Trading has advised that penalties for non-compliance will be imposed from April 2021. A person who does not comply is guilty of an offense (maximum penalty $550).

On 18 December 2020, the new mandatory Code of Conduct, and the accompanying Fair-Trading Amendment (Short-term Rental Accommodation) (No 2) Regulation 2020 commenced. 

NSW STRA Fire safety requirements grace period
You must have registered your property before 1 November to take bookings for summer. Due to COVID-19 stay at home orders, some hosts have been unable to travel to their properties or secure tradespeople to ensure they are compliant with the fire safety standards.

The Grace Period
As a temporary measure, the fire and safety requirement has been delayed until 1 March.
